Data Processing Agreement

Overview

This Data Processing Agreement ("DPA") governs the processing of personal data that a customer ("Controller") provides to OnCallKeeper ("Processor") when using our Services.

This DPA is incorporated into the OnCallKeeper Terms of Service or applicable order form.

Key definitions

For purposes of this DPA:

  • Personal Data — information relating to an identified or identifiable natural person
  • Processing — any operation performed on Personal Data
  • Subprocessor — a third party engaged by OnCallKeeper to process Personal Data
  • Applicable Data Protection Laws — GDPR, KVKK, CCPA, and other relevant regulations

Roles and scope

The Customer is the Controller. OnCallKeeper acts as Processor, processing Personal Data only on documented instructions and for the purpose of providing the Services.

OnCallKeeper will not process Personal Data for unrelated purposes without instruction or legal requirement.

Security measures

OnCallKeeper implements appropriate technical and organizational measures, including encryption in transit, access controls, logging, and incident response procedures.

Subprocessors

We may engage subprocessors for hosting, payments, email, SMS, and analytics. An up-to-date list is available on request or in our Trust Center.

We impose data protection obligations on subprocessors consistent with this DPA.

Personal data breaches

OnCallKeeper will notify the Customer without undue delay after becoming aware of a Personal Data Breach affecting Customer Personal Data, and cooperate on remediation as required by law.

Data subject requests

OnCallKeeper will assist the Customer in responding to data subject requests under Applicable Data Protection Laws, to the extent legally permitted.
